SparkCore is software for running a real estate business: a contact database, an AI assistant, marketing and farming tools, texting and calling, websites, and reporting, sold as a monthly subscription by Spark Noir Creative LLC ("we", "us"). These terms are a contract between your business and ours, effective when you create an account or subscribe.
You need to be a real person running a real business, give us accurate information, and keep your password to yourself. You are responsible for what happens under your login. If someone on your team misuses the platform, that is on your account.
We can suspend accounts that break these terms, abuse the platform, or create risk for other customers, and we will tell you why.
Your contacts, notes, messages, documents, and everything else you put into SparkCore belong to you. We host and process them to run the service for you, and for nothing else. We do not sell your database, mine it for other customers, or hold it hostage: you can export your contacts at any time, on any plan, including after you cancel.
We keep backups and take security seriously, but you should keep your own exports of anything you cannot afford to lose. Our privacy practices are described in the Privacy Policy.
SparkCore sends texts, calls, and emails on your behalf, at your direction, from numbers and addresses registered to your business. Legally, you are the sender of record. SparkCore builds the guardrails in: Do Not Call flags, STOP handling, quiet hours, unsubscribe links, and carrier registration are enforced automatically, and automated sending is held to stricter rules than your own manual sending.
Those guardrails do not transfer your legal responsibility to us. You are responsible for having the right to contact the people in your database and for how you use override choices the product gives you. If a law applies to your outreach (TCPA, CAN-SPAM, your state's rules, your MLS's rules), it applies to you.
SparkCore's AI drafts messages, answers calls when you miss them, scores your database, and suggests who to contact. It always discloses that it is an AI, high-touch messages wait for your approval, and predictions like the seller score are estimates from data, not promises. A high score is a reason to call someone, not a guarantee they will sell.
Nothing the AI produces is legal, tax, or financial advice. You review what goes out in your name; the judgement calls of your business remain yours.
Subscriptions bill monthly through Stripe, in advance, and renew until you cancel. You can upgrade, downgrade, or cancel any time; cancellation stops the next renewal and your account stays usable until the paid period ends. Founding-member discounts are permanent for as long as the subscription stays active.
Metered allowances (property data records, skip traces, AI usage) reset monthly and do not roll over. If a payment fails we retry and tell you before anything is suspended.
Parts of SparkCore run on third-party providers: payment processing, telephone carriers, email delivery, property data, and AI models. Their availability affects ours, and their acceptable-use rules (for example, carrier rules about text content) apply to traffic you send through them.
SparkCore is provided as it is, without warranties of uninterrupted service or of particular business results. To the extent the law allows, our total liability to you is capped at what you paid us in the twelve months before the claim, and neither of us is liable to the other for indirect or consequential damages. Nothing in these terms limits liability that cannot lawfully be limited.
We improve the product constantly and may change features over time; we will not materially reduce what your plan includes mid-cycle without telling you. If we change these terms, we will post the new version here and note the date; continuing to use SparkCore after a change means you accept it.
These terms are governed by Arizona law. If a dispute cannot be worked out like adults, it belongs to the state or federal courts of Maricopa County, Arizona.
